Information to the processing of personal data for the ToxNet Award

We, Merz Therapeutics GmbH („Merz“, “we”), Eckenheimer Landstrasse 100, 60318 Frankfurt am Main, Germany, datenschutz-therapeutics@merz.de process personal data about you in the context of our Toxnet Award for most promising colleague in spasticity management (“Award”). Merz is the controller for the processing of your personal data as defined in the General Data Protection Regulation (Regulation (EU) 2016/679; “GDPR”).

The website where the application form can be filled in is provided by Thinkology Limited, doing business as EveryView (“EveryView”), 34-36 Fore Street, BoveyTracey, Newton Abbot, Devon TQ13 9AD, England, on our behalf. EveryView acts in accordance with our instructions.

The Toxnet award aims to recognise individuals in the early/mid stage of their career in spasticity management (< 10 years specialising in spasticity management) who are already making an impact in medical science, clinical practice, or medical education.

This award recognizes outstanding potential and early contributions to the field of spasticity management, celebrating innovative research, exceptional clinical practice, and significant advancements in medical education.

To be able to nominate an award winner, personal data is collected from you, such as your name, e-mail address, position, and information about your professional qualification and the duration of your professional experience.

Personal data about you is also processed when you access the application form via the web. When the corresponding website is accessed, the servers automatically store various data about the accessing system. This includes the type of browser used, the browser version, the operating system used, the website from which the website is accessed, the subpages of the website accessed, the date and time of access, the Internet Protocol address (IP address), the Internet service provider and data comparable with this data. This data is used to enable access to the feedback website and to identify and rectify any technical problems that may occur.

The website also uses cookies. Cookies are small text files that are stored on the user’s data carrier and exchange certain settings and data with the system via the browser. A cookie usually contains the name of the domain from which the cookie data was sent, information about the age of the cookie and an alphanumeric identifier. The cookies set on the Feedback website are technically necessary in order to operate the website and enable users to use its functions.

The legal basis for processing your personal data is your voluntary consent (Art. 6 para. 1 lit. a) GDPR). You can withdraw your consent at any time without affecting the lawfulness of the processing before the withdrawal.

For the technical processing of personal data, Merz and EveryView are supported by specialized technical service providers. These service providers are carefully selected and are contractually obligated to ensure a high level of data protection.

If personal data is transferred to parties outside the European Economic Area, these are either in a country for which the European Commission has decided that this country ensures an adequate level of data protection, or an adequate level of data protection is established by standard contractual clauses approved by the European Commission and concluded between Merz or EveryView and the respective party. Your personal data will be deleted or destroyed by Merz in a data protection compliant manner when it is no longer required for the purposes for which it was collected.

Pursuant to the GDPR, you have a right to access to the personal data stored by Merz and, if the legal requirements are met, a right to rectification, erasure or restriction of processing, as well as a right to receive the personal data you have provided in a structured, commonly used and machine-readable format and/or to transmit it to another controller or to have it transmitted by Merz to such controller.

The following criteria will be judged out of a score of 5; (1 is suboptimal; 2 is adequate; 3 is good; 4 is very good; 5 is excellent)

  • Average number of spasticity patients managed per month
  • Environment and clinical team (type of institution, location, size/structure of clinical team, particular patient needs)
  • Role of responsibility in managing patients with spasticity
  • Scientific appointments in spasticity
  • Honours for work undertaken in spasticity

SCHOLARLY

  • Number of research projects investigating relevant aspects of spasticity management
  • Impact of research projects investigating relevant aspects of spasticity management
  • Number of peer-reviewed publications on topic
    Number of presentations of research at international meetings
  • Number of presentations at national conferences
  • Teaching/mentorship of younger injectors
  • h-index

CLINICAL

  • Evidence of development or growth of a spasticity program at the applicant’s practice or institution
  • Breadth of services provided, including medications, toxins, physical interventions, and Intrathecal Baclofen Therapy (ITB)
  • Role of responsibility in managing patients with spasticity

ENDORSEMENT

  • Endorsed by senior peer

In the event of a tie, based on the above scoring criteria, the Toxnet Co-Chairs will make the final decision.
